Extended sales time limit

 

The "Announcement" requires that infant formula milk powder imported by general trade should be registered by the General Administration of Quality Supervision, Inspection and Quarantine according to law by foreign manufacturers; infant formula milk powder exported to China produced by overseas manufacturers after January 1, 2018 (inclusive) Powder, the product formula registration of the General Administration of Food and Drug Administration should be obtained in accordance with the law, and the registration number should be indicated on the label of the product sales package; infant formula milk powder produced by foreign production enterprises before January 1, 2018 can be imported and sold until the end of the shelf life .

 

At the same time, the "Announcement on Adjusting the Transition Period for the Registration and Management of Formula Foods for Special Medical Purposes" was also issued, stipulating that "From January 1, 2019, formula foods for special medical purposes produced in or exported to China shall comply with the law. Obtain a registration certificate for formula food for special medical purposes, and mark the registration number on the label and instructions. "This regulation adjusts the transition period for the registration management of formula food for special medical purposes, and the official implementation time of registration is extended from January 1, 2018 to 2019. January 1st.

 

Special formula milk powder is a special medical food. The China Securities Journal reporter noted that on November 20, the State Food and Drug Administration approved a total of three special medical use formula food registrations for two companies, namely three brands of special medical use infant formula powder.

 

According to the "Announcement on the Implementation of the Transition Period for the Registration and Management of Infant Formula Milk Powder Products" issued on September 30, 2016, infant formulas that have been approved for production and sales in China before January 1, 2018, or have been exported to China Milk powder can be sold until the end of its shelf life; from January 1, 2018, infant formula milk powder produced in China or exported to China must obtain an infant formula milk formula registration certificate. According to this regulation, if imported milk powder has not obtained the formula registration certificate before January 1, 2018, it will not be sold in China.

 

However, according to the latest "Announcement on the Implementation Date of the Registration of Imported Infant Formula Milk Powder Products", "Infant formula milk powder produced before January 1, 2018" can also be imported if it has not obtained a formula registration certificate And sales until the end of the shelf life ", which is equivalent to extending the import and sales time of unregistered imported milk powder.

 

Formula registration system implemented as scheduled

 

Since the approval of the first batch of registration applications on August 3, as of November 14, China has registered 598 recipes from 93 factories, including 486 recipes from 70 factories in China and 112 recipes from 23 factories overseas. Judging from the quantity comparison, it is mainly domestic milk powder companies that have obtained formula registration certificates. Foreign milk powder companies have made slow progress in formula registration. Investigating the reasons, experts believe that during the registration process, importing companies will have more procedures when preparing materials, such as Chinese-English translation, notarization and certification, and some communication time for technical information from foreign factories. The procedures are more complicated.

 

The industry has higher expectations for the registration system to boost the milk powder market. According to previous predictions, with the implementation of the registration system, about three-quarters of the milk powder companies will be cleared out, and by 2018 may vacate the market by about 15 billion yuan. Large domestic milk powder companies are also scrambling on the post-registration market. According to the Beinmei announcement, since the first batch of registered recipes was announced in August, Beinmei has signed more than 3 billion underwriting contracts. The new regulations for foreign milk powder produced before January 1, 2018, which can be imported and sold without registration, will undoubtedly "weaken" the benefits of milk powder companies that have obtained registration certificates.

 

Dairy industry expert Song Liang pointed out that proper extension of the import and sale time of milk powder without a registration certificate can free up a certain period of time for these enterprises to digest their inventory; It is possible to enter the Chinese market through cross-border purchases, which will also weaken the "benefit" brought about by the implementation of the registration system for domestic milk powder. However, according to the documents, the implementation time of the recipe registration system will not be postponed. At present, there is sufficient milk powder in the market, and enterprises can continue to apply for registration next year.
